EU responsible person for US sellers

A US LLC or corporation selling physical goods to EU consumers needs, since 13 December 2024, a responsible person established in the EU whose name and contact details appear on the product and in the listing. Many US brands also need a GDPR Article 27 representative for their EU customer data. Both can be the same Maltese company.

Why your US address is not enough

EU authorities want someone they can reach inside the Union, with the technical file at hand. Article 16 of GPSR makes that person the condition for placing the product on the market at all. Marketplaces enforce it with mandatory fields because the Regulation gives online marketplaces duties of their own (Article 22).

FBA does not solve it by itself

Using Amazon's European fulfilment centres does not make Amazon your responsible person. A fulfilment service provider can be one, but only if it agrees to and is named as such. Amazon asks you to name your own.

What we need from you

Company details, product list and categories, a short technical file per product, label artwork, listing screenshots. We refuse toys, electronics, cosmetics, supplements, medical and PPE products. For the accepted categories, the file is usually a few pages.
